2)      Receive camp credit for a future reservation

3)      Full cancellation with a $75 fee, any remaining balance will be refunded.

Rules & regulations

Park Rules

Urgent Matters: If the guest has a true emergency, please dial 911. If there is an urgent matter that cannot wait till the next business day, please dial our main phone number and leave a voicemail in order to receive a return call. You may also dial the property manager at 737-808-0845.

· DO NOT WALK THRU OCCUPIED OR UNOCCUPIED SITES.

· All buildings in the park are smoke-free.

· A small refrigerator or freezer may be placed on your RV site in an inconspicuous place.

· Guests must maintain a clean, clutter free and orderly RV Site.

· Unused items should be stowed away inside your RV or in storage.

· No changes to RV site without the prior consent of park management.

· Decks, Canopies, and Storage Sheds require approval by Park prior to installation.

· RV’s should have no visible damage, or disrepair. There can be no window A/C units, torn awnings, tarps, tape, plastic or boarding of windows.

· It is MANDATORY and TEXAS LAW requires that a sewer hose must be fastened using threaded connector or rubber donut.

· Water hoses and connections should be leak free. All hoses, electric cables and cords must be coiled neatly and kept up off the grass.

· Cutting of trees and plants is prohibited. No screws, bolts or nails in Park trees.

· No dumping anything on the ground that may harm the grass or landscaping.

· No clothes lines or racks.

· Do not hang anything on Austin RV N fencing.

· Vehicle washing, oil changes and vehicle repairs are prohibited.

· No BB gun, pellet gun, air gun, and/or paintball gun use is allowed in Park. If you own a firearm you must adhere to Texas laws and regulations.

· FIREWORKS of any kind are PROHIBITED.

Quiet Time

· Quite Time is 10:00 pm to 8:00 am. Please be considerate of your neighbors.

· Should the Sheriff’s Office be notified regarding a disturbance at your site, you will be required to vacate the park.

Laundry/Bathhouse

· Absolutely no washing of pet bedding, pet sheets, and/or pet blankets. Please use outdoor water facilities for such.

· No pets inside the laundry or bathhouse.

· Please pick up/clean up after using the facilities, such as, rinse the shower, sink, etc.

Parking

· Park ONLY at your RV site. Vehicle owners who elect to park vehicles at locations other than their own site shall incur an RV Site Fee charge at the daily rate.

· Other than for loading/unloading, No parking on the road, grass or other RV sites.

· Should temporary parking be needed, please inquire at the office telephone number.

Guest & Children

· Only persons 18 years of age and older are allowed to drive carts, buggies, or vehicles on Park property.

· YOU are responsible for the actions of your children and your guests.

Pets

· Your pet is your responsibility, you are required to pick up your pet’s waste and properly dispose of it.

· No leashed, unattended pets outside of RV at any time, for any reason.

· When outdoors, PETS MUST BE ON A LEASH AT ALL TIMES.

· No Electric Fencing or Electric Collars Allowed.

· Guest with excessively loud or disorderly pet(s) will be asked to vacate the property.

· Do NOT allow your dog to “relieve itself” on other people’s sites.

Waste Disposal

· NO TRASH MAY BE LEFT OUTSIDE.

· No outside trash cans at RV sites.

· ONLY Household trash in dumpsters.

· Before disposing of boxes, break them down.

Business & Subleasing

· No business is allowed to operate out of an RV unit within the Park.

· No subleasing or renting of RV units on Park Property.

Failure to comply with any of the rules stated above will result in being asked to leave the park.

RV SITE SERVICE AGREEMENT THIS AGREEMENT DOES NOT CREATE A LANDLORD/TENANT RELATIONSHIP

RV Site: Campground hereby provides service on RV Site No. (“RV Site”) of Campground’s property. The campground has the right, for any reason, with a twenty-four (24) hour notice to relocate the Guest to a substantially equivalent Lot on Campground’s property.

Background Screen: A mandatory Criminal Background Screen is performed for each RV Site Service Agreement Applicant eighteen (18) years of age and older. The charge for the background screen is $27.00 per applicant and is payable to the Campground before the background screen is performed. Only the Guest(s) whose signature(s) appear below on this Agreement may reside at this RV Site. Other than daily intermittent visits, no one eighteen (18) years of age or older may stay at the RV Site until a Background Screen is performed and approval to stay at the RV Site is obtained from the Campground.

Additional Charges:

-Any additional people will be charged a fee based on length of stay, the daily rate is $5.00 per day per person, and the monthly charge of $75.00, per person.

-Cargo/flatbed trailers, boats, and approved personal storage units have an additional monthly charge of $25.00 per item.

-A third vehicle is an additional monthly charge of $25.00. Two motorcycles equate to 1 vehicle.

Items Requiring Approval from Management:

Gazebos, decks, golf carts, small outdoor refrigerators/freezers, and any structure.

Rules and Regulations: Guests and invitees shall comply with the written Park Rules provided to Guest and attached hereto. The guest agrees to comply with all state and federal laws, rules, ordinances, and regulations applicable to the Campground’s property.

Campground’s Right to Terminate Agreement: Campground may, at its discretion, terminate this Agreement for any or no reason by providing Guest a notice to leave Campground (“Notice of Termination of Agreement”). Guest agrees to render peaceful possession of the RV Site to Campground within three (3) days of the Date of the Notice of Termination of Agreement. The three (3) day notice shall not be required if termination is the result of any Acts of Default (as defined below). Upon Guest surrender of the RV Site to Campground, Campground will not refund to Guest any unused Monthly RV Site Fee paid by Guest to Campground.

Default by Guest:

The following acts constitute default by Guest (“Acts of Default):

a.) Failing to timely pay the Monthly RV Site Fee, or other lawful charges when due under this Agreement.

b.) Giving false information on any application to Campground.

c.) Onerous, obnoxious, or offensive activity of any sort that could interrupt and/or adversely affect the enjoyment of other parties utilizing Campground facilities.

d.) Committing serious misconduct or criminal acts.

e.) Guest themselves and/or their invitees who fail to comply with the terms and conditions of this agreement.

f.) Guest remaining on Campground property after giving Campground Notice of Non-Renewal; and/or

g.) Guest remaining on Campground property after Campground gave to Guest Notice of Termination of Agreement. There is no refund to Guest for their Default of Agreement Early.

Termination by Guest:

Campground, at its discretion, may recover as damages for Guest early termination of this Agreement, an amount equal to the amount that remains outstanding as of the Agreement Term or as recalculated by Campground.

Accidents, Injuries, or Loss: Campground assumes no responsibility for accidents, injuries, or loss from any cause. Empty RV Sites shall not be used for parking of any kind.

Condition of RV Site: By executing this Agreement, the Guest acknowledges and agrees that the RV Site is in good condition and adequate for Guest use. Upon termination or expiration of this Agreement, the Guest agrees to surrender the RV Site to Campground in a similar, good condition. If the Guest fails to leave the RV site in good condition, Campground shall assess reasonable site cleaning charges to Guest for Campground’s effort to return RV Site to good condition and adequate for Guest use.

Assignment: Guest shall not have the right to assign or sublet RV Site hereunder to any person or persons. Attorney’s Fees: In the event any legal proceedings are initiated to collect unpaid RV Site Fees, electrical charges, storage charges, or site cleaning charges, Campground may also attempt to collect from Guest all reasonable costs and attorney’s fees incurred by Campground in pursuing such action.

Waiver: Campground’s failure to insist on strict compliance with the terms of this Agreement shall not be deemed a waiver of that term or condition, nor shall any waiver or relinquishment of any right or power at any one time or times to be deemed a waiver or relinquishment of the right or power for all or any other times.

Notices: All written notices and communications regarding this Agreement, including notices sent pursuant to TEX. PENAL.CODE 31.04(c), should be sent to the designated undersigned persons at the address on file unless notified in writing to the contrary by the receiving party. The notice shall become effective as of the date of mailing by certified mail.

Severability: If any provision of this Agreement is held illegal, void, or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Agreement shall remain operative and binding on the parties.

NO LIABILITY:

GUEST HEREBY INDEMNIFIES, RELEASES, AND AGREES TO PROTECT AND HOLD HARMLESS CAMPGROUND, ITS OFFICERS, OWNERS, EMPLOYEES, AND AGENTS (“PARTIES”), FROM AND AGAINST ALL CLAIMS, CAUSES OF ACTION, AND/OR LIABILITY ARISING OUT OF OR RELATED TO GUEST’S USE OF THE RV SITE, CAMPGROUND’S PROPERTY, AND/OR ANY CONDITION THEREIN, WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF OR THE NEGLIGENCE OF CAMPGROUND PARTIES. THEFT OF SERVICE ACCORDINDING TO TEXAS PENAL CODE SECTION 31.04, a person commits theft of service if, with intent to avoid payment for service that actor knows is provided only for compensation, the actor intentionally or knowingly secures the performance of the service by agreeing to provide compensation and, after the service is rendered, fails to make full payment after receiving notice demanding payment. “Intent to avoid payment” is presumed if the actor absconded without paying for the service or expressly refused to pay for the service in circumstances where payment is ordinarily made immediately upon the rendering of the service, as in recreational vehicle parks. That is any guest who leaves without paying for site services or who refuses to pay for site services when due may be subject to criminal prosecution. We will prosecute any violation under the “THEFT OF SERVICE LAW.” CRIMINAL TRESPASS ACCORDING TO TEXAS PENAL CODE SECTION 30.05, a person commits an offense if the person enters or remains on or in property of another, including a recreational vehicle park, without effective consent and the person had notice that the entry was forbidden, or received notice to depart but failed to do so. That is, any guest who receives notice to leave and refuses to do so may be subject to criminal prosecution. If we ask you to leave, you must vacate the Campground’s property. We will prosecute any violations under the “CRIMINAL TRESPASS LAW.” This Agreement becomes effective only when Campground has signed the Agreement and returns it to Guest. THIS AGREEMENT IS A SITE SERVICE AGREEMENT AND DOES NOT CREATE A LANDLORD/TENANT RELATIONSHIP.
